These Terms are between you and Maestro Technologies (“Maestro,” “we,” “us,” or “our”), the operator of Shark Alert and sharkalert.app. They govern your access to sharkalert.app and the Shark Alert coastal-awareness service. By using the service, you agree to them. SMS participation is also governed by the SMS Program Terms.
1. Eligibility and authority
You must be at least 18 years old or use the service with permission from a parent or legal guardian. If you enter a mobile number, you represent that you are the subscriber or customary user of that number and are authorized to enroll it.
2. The service
Shark Alert provides informational notices about certain recent reported shark observations in participating areas. Features, sources, geographic coverage, qualification rules, delivery channels, and availability may change. We may correct, delay, suppress, or remove reports when needed for quality, safety, legal compliance, or system operation.
3. Important limits of observation data
An alert reflects a report associated with a past time and location. Animals move. Data may be delayed, incomplete, duplicated, inaccurately identified, unavailable, or wrong. The absence of an alert does not mean an area is free of sharks or other hazards. An alert does not mean an animal remains at the reported location or presents a particular level of risk.
4. Your safety decisions
You are responsible for your activities and safety decisions. Do not rely on Shark Alert as the sole or primary basis for entering, remaining in, or leaving the water. Follow lifeguards, beach closures, posted warnings, weather and ocean conditions, local government, and emergency authorities. Call 911 for immediate danger.
5. Access and acceptable use
You must provide accurate information, protect private management links, and promptly opt out a number you no longer control. You may not interfere with the service; probe or bypass security; automate abusive requests; enroll another person without authorization; scrape or resell service data; impersonate another person; or use the service unlawfully.
6. Third-party data and services
Observation reports, maps, telecommunications, links, and other content may come from third parties. Their own terms may apply. We do not control and are not responsible for third-party services, carrier networks, source outages, or external content. Attribution does not imply endorsement.
7. Intellectual property
Shark Alert’s name, logos, design, original software, and original content are owned by Maestro Technologies or its licensors and protected by law. These Terms grant you a limited, revocable, non-transferable right to use the service for personal, lawful purposes. No other license is granted.
8. Availability and termination
We may modify, suspend, or discontinue some or all of the service. We may restrict access for abuse, security risk, legal compliance, source restrictions, or violation of these Terms. You may stop using the service at any time and may stop text messages as described in the SMS Program Terms.
9. Disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available.” Maestro Technologies disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, timeliness, availability, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties that cannot legally be excluded.
10. Limitation of liability
To the fullest extent permitted by law, Maestro Technologies and its owners, personnel, contractors, licensors, data sources, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; personal decisions made in reliance on the service; loss of data, profits, goodwill, or use; or unavailable, delayed, inaccurate, incomplete, or undelivered observations or messages. To the fullest extent permitted by law, aggregate liability for all claims relating to the service will not exceed the greater of $100 or the amount you paid Maestro Technologies during the 12 months before the event giving rise to the claim. These limitations do not apply where prohibited by law.
11. Indemnity
To the extent permitted by law, you agree to defend and indemnify Maestro Technologies from third-party claims arising from your unlawful misuse of the service, unauthorized enrollment of a number, or material violation of these Terms. This section does not require indemnification for Maestro Technologies’s own unlawful conduct.
12. Governing law and disputes
Before filing a claim, you and Maestro Technologies agree to try in good faith for 30 days to resolve it informally by email. These Terms are governed by South Carolina law, without regard to conflict-of-law rules. Unless applicable consumer law requires otherwise, claims must be brought in a court of competent jurisdiction in Charleston County, South Carolina. You may also bring an eligible claim in small-claims court.
13. General terms
If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our permission; we may assign them as part of a reorganization or transfer of the service. These Terms, the SMS Program Terms, and the Privacy Policy are the entire agreement concerning the service.
14. Changes and contact
We may update these Terms and will post a revised effective date. Material changes will receive additional notice when required. Questions may be sent to support@sharkalert.app.
